Terms of Service for Formkilo

1. Acceptance of Terms

By accessing and using Formkilo, you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service constitute a binding agreement between you and Cyrush LLC. If you do not agree to abide by the above, please do not use this service.

2. Changes to Terms

Cyrush LLC reserves the right to change these terms and conditions at any time. Your continued use of Formkilo following the posting of changes to these terms will mean you accept those changes.

3. Use License

Permission is granted to temporarily download one copy of the materials on Formkilo for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or for any public display (commercial or non-commercial);
• attempt to decompile or reverse engineer any software contained on Formkilo;
• remove any copyright or other proprietary notations from the materials.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Cyrush LLC at any time.

4. User Conduct

You agree not to use Formkilo to:

• Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
• Impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
• Upload, post, or transmit any unsolicited or unauthorized advertising, promotional materials, spam, or any other form of solicitation;
• Upload, post, or transmit any material that contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer software or hardware;
• Interfere with or disrupt Formkilo or servers or networks connected to Formkilo.

5. Email Usage and Anti-Spam Policy

You agree to use Formkilo's email services responsibly and in compliance with applicable anti-spam laws, including but not limited to the CAN-SPAM Act and GDPR. Specifically:

• You may only send emails to recipients who have explicitly consented to receive communications from you;
• You must provide clear and functional unsubscribe mechanisms in all emails;
• You must not send spam, bulk unsolicited emails, or engage in email practices that violate applicable laws;
• You must not use purchased, rented, or third-party email lists without proper consent verification;
• You must not send emails containing malicious content, phishing attempts, or fraudulent material;
• You must not use our services to promote or sell illegal products, counterfeit goods, fraudulent schemes, deceptive practices, or any products or services that violate applicable laws or regulations;
• You must not engage in misleading advertising, false claims about products or services, or any form of deceptive marketing practices.

Account Suspension and Termination: Cyrush LLC reserves the right to immediately suspend or terminate your account and block access to Formkilo if we determine, in our sole discretion, that you are engaged in spammy behavior, violating anti-spam laws, or otherwise misusing our email services. This action may be taken without prior notice and without refund of any fees paid.

6. Intellectual Property

The service and its original content, features, and functionality are and will remain the exclusive property of Cyrush LLC and its licensors. The service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Disclaimer of Warranties

The materials on Formkilo are provided on an 'as is' basis. Cyrush LLC makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.

9. Limitation of Liability

In no event shall Cyrush LLC or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Formkilo, even if Cyrush LLC or a Cyrush LLC authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Cyrush LLC and its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities and expenses (including reasonable attorney's fees) relating to or arising out of your use of Formkilo, including but not limited to your violation of any terms of this Agreement, your violation of any rights of a third party, or your violation of any applicable laws, rules or regulations.

11. Termination

Either party may terminate this Agreement at any time. Cyrush LLC may terminate your access to Formkilo at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use Formkilo will cease immediately.

12. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the United States and you irrevocably submit to the exclusive jurisdiction of the courts in that state or location.

13. Severability

If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
